Search Terms of Business

FOR SEARCH AND SELECTION ASSIGNMENTS (Permanent Recruitment)

1. These terms apply to any appointment made with the assistance of BIE Group Ltd (‘the Company’), unless we have agreed to vary them. (The term ‘Candidate’ refers to the person introduced by the Company to the Client).

2. For executive selection our fee is based on 30% of the successful Candidate’s remuneration package, and for executive search the fee of the Company is calculated at 33% of the successful Candidate’s remuneration package. Our minimum fee level for search assignments is £25,000. Where a search results in 2 or more placements, our fees for the second placement onwards are 25% of package. Placements for contingent recruitment are 25% of package.

3. a. Fees will be payable as follows; on acceptance of the assignment by the Employer (hereinafter called ‘the Client’), a retainer fee is due immediately; a short list fee is payable upon the presentation to the Client of a short list of candidates who meet the agreed specification and at least one of these is taken to second stage interview; a completion fee is payable on receipt, by the Client, of the successful Candidate’s signed acceptance of the employment offer. Where an assignment is accepted by the Client and the Company on a retained basis and the Client subsequently cancels the assignment, at the cancellation stage, the retainer and short list fee, or equivalent(completion fee), plus any additional advertising and other agreed costs will be payable by the Client immediately.

3. b. Where an assignment is handled on a contingency basis the full fee will be payable on candidates signed acceptance of the employment offer.

4. The fee payable to the Company by the Client for the introduction of a Candidate is calculated as a percentage of the Candidate’s first 12 months gross equivalent annualised remuneration, including bonuses, profit share etc. Car allowances are included in the calculation of remuneration. A company car shall be deemed to be the equivalent of a £8,000 addition in remuneration. Where bonuses are not guaranteed, they will be deemed to be 2/3 of the potential bonus quoted to the Candidate.

5. a. If a Candidate leaves (the Client) within 6 months of an appointment, provided this is not the result of restructuring, redundancy, or a change of reporting lines, we undertake to do the work again at no extra cost to the Client provided that the Client has paid all the Company’s fees within 14 days of the invoice.

5. b. Should the Client or any subsidiary or associated company of the Client subsequently re-engage the Candidate, or the use of a candidate, within the period of 12 calendar months from the date of termination a full fee in accordance with Paragraph 2 above becomes payable.

6. An introduction fee calculated in accordance with Paragraph 2 of these Terms will be charged in relation to any Candidate engaged as a consequence of or resulting from an introduction by or through the Company, even though the introduction may be made indirectly.

7. Introductions are confidential. The passing on of an introduction to another employer, which results in an engagement, renders the Client liable to payment of the Company’s fee as set out in Paragraph 2.

8. The Client shall be responsible for obtaining work and other permits, for the arrangement of medical examinations and/or investigations in the history of any Candidate and satisfy any medical and other requirements or qualifications required by law.

9. The Company shall not be liable under any circumstances for any loss, damage or expense suffered or incurred by the Client arising from or in any way connected with the Company seeking a Candidate for the Client or the introduction by the Company to the Client of any Candidate or the engagement of any Candidate by the Client.

10. Any curriculum vitae’s relating to the retained assignment, introduced to the client by 3rd parties, should be forwarded immediately to Archer Mathieson and included in the screening process. In the event of a ‘3rd party introduced’ candidate being successful in securing the position a cancellation fee, according to point 3, will apply.

11. Advertising expenses and the costs of associated artwork and typesetting are payable when the advertising is booked.

12. Our invoices are payable within 14 days of the date of the invoice.
